LIMITED PRODUCT WARRANTY
Effective Date: April 2025

This Limited Product Warranty is issued by APTERIX Performance Films LLC (“APTERIX” or “Company”) and applies only to eligible APTERIX products professionally installed and timely registered in accordance with the terms below.

1. Definitions

For purposes of this Limited Product Warranty:

  • “Company” means APTERIX Performance Films LLC.

  • “Product” or “Products” means APTERIX paint protection film, windshield protection film, marine protection film, and automotive window film products sold by the Company.

  • “Authorized APTERIX Installation Center” means an installation center or facility approved by the Company to install APTERIX Products.

  • “Original Owner” means the original retail purchaser of the Product for the vehicle, vessel, or other approved application in which it was first installed.

  • “Proof of Installation” means a signed invoice from an Authorized APTERIX Installation Center or facility identifying the installed Product and the vehicle, vessel, glass, or approved application.

  • “Warranty Period” means the applicable coverage period listed in Section 3.

  • “Registration Date” means the date the Product warranty registration is completed and accepted by the Company.

  • “Registered Product” means only the specific Product identified in the accepted warranty registration.

  • “VLT” means visible light transmission.

  • “TSER” means total solar energy rejected.

2. Conditions of Warranty

All APTERIX Products must be stored, handled, installed, used, and maintained in accordance with all instructions, specifications, installation guides, and care requirements provided by APTERIX. Failure to comply with those requirements may void this Limited Product Warranty.

This Limited Product Warranty applies only if:

  • The Product is professionally installed by an Authorized APTERIX Installation Center or facility.

  • The Product is registered with the Company within thirty (30) days from the date of installation.

  • The claimant provides valid Proof of Installation.

  • The Product remains installed in the country where it was originally purchased.

  • The Product has not been altered, misused, improperly maintained, or removed without authorization.

Warranty coverage begins on the Registration Date, provided registration occurs within thirty (30) days after installation. If the Product is not registered within that thirty (30) day period, no warranty coverage shall apply.

3. Product Warranty Coverage

APTERIX warrants to the Original Owner only that, during the applicable Warranty Period, the Registered Product will be free from qualifying manufacturing defects, subject to all terms, conditions, limitations, and exclusions in this Limited Product Warranty.

Applicable Warranty Periods:

  • APTERIX: PRO — Fifteen (15) years

  • APTERIX: EVO — Fifteen (15) years

  • APTERIX: CLR — Ten (10) years

  • APTERIX: WPF — Three (3) years

  • APTERIX: AQUA — Three (3) years, above the water line only

  • APTERIX: SLR — Lifetime, for as long as the Original Owner owns the vehicle in which the Registered Product was originally installed

3.1 Paint Protection Film Products

For APTERIX Pro, APTERIX Evo, APTERIX CLR, APTERIX WPF, and APTERIX AQUA, qualifying manufacturing defects may include cracking, blistering, delaminating, and discoloration resulting solely from manufacturing defects.

3.2 Window Film Products — APTERIX:SLR

For APTERIX:SLR, qualifying manufacturing defects may include cracking, bubbling, blistering, peeling, delaminating, adhesive failure, and abnormal discoloration resulting solely from manufacturing defects.

APTERIX:SLR is intended for approved automotive glass applications only unless otherwise approved in writing by the Company.

4. Window Film Performance and Legal Compliance

Any published, advertised, quoted, or stated values for VLT, TSER, ultraviolet rejection, infrared rejection, glare reduction, solar reflectance, shade level, darkness level, or similar performance metrics are product performance specifications only and are not separate warranties of legality, suitability, or guaranteed field performance.

Performance values may vary based on, among other things:

  • Glass type, thickness, color, condition, and factory tint

  • Combined glass-and-film configuration

  • Installation quality and placement

  • Measurement method, instrument calibration, and testing environment

  • Vehicle design, angle of light, weather, climate, altitude, and other real-world conditions

Nominal film VLT is not the same as final installed VLT. Final installed VLT depends on the combined glass-and-film system and may differ from the nominal rating of the film alone.

Any ultraviolet, infrared, TSER, VLT, or similar performance claim applies only to the specific Product and testing conditions identified by APTERIX and does not guarantee identical results in every vehicle, installation, climate, glass type, or jurisdiction.

The Original Owner and installer are solely responsible for determining whether the selected APTERIX:SLR Product and the final installed glass-and-film combination comply with all applicable federal, state, provincial, territorial, and local laws, regulations, and inspection standards in the place where the vehicle is registered, operated, sold, or inspected.

APTERIX does not warrant or guarantee that any particular APTERIX:SLR Product, shade, VLT level, reflectivity level, or installed configuration is lawful in any jurisdiction. Any statement, chart, recommendation, product description, or installer communication regarding VLT, shade, darkness, reflectivity, or legal use is informational only and is not legal advice or a warranty of compliance.

Any citation, fine, failed inspection, removal order, enforcement action, required film removal, or other consequence arising from applicable law, regulation, inspection standard, or measuring results is excluded from warranty coverage.

5. Exclusive Remedies

If APTERIX determines that a Registered Product is defective due solely to a qualifying manufacturing defect during the applicable Warranty Period, APTERIX may, at its sole option:

  • Remove and replace the defective Registered Product

  • Provide replacement film limited to the Registered Product

  • Issue a store credit to the Original Owner equal to the value of replacement film for the Registered Product

Any replacement film, replacement Product, or store credit is limited strictly to the film registered under the warranty.

This Limited Product Warranty does not extend, restart, or renew the original Warranty Period.

Labor, diagnostics, installation charges, removal charges, shipping, travel, downtime, and any other non-product costs are not covered unless expressly approved in writing by APTERIX.

6. Warranty Claim Procedure

To request warranty service, the Original Owner must submit all of the following:

  • Warranty registration confirmation or other proof of accepted registration

  • Proof of Installation in the form of a signed invoice from an Authorized APTERIX Installation Center or facility

  • A copy of the installation receipt identifying the Product and covered area or application

  • A written description of the alleged defect

  • Documented photographic proof of the alleged defect

  • Current contact information

  • Installation location and current vehicle, vessel, or application location

Any warranty claim must be submitted within thirty (30) days after discovery of the alleged defect. Failure to submit a claim within that thirty (30) day period, together with documented photographic proof, may result in denial of coverage.

APTERIX reserves the right to inspect the Product in person before approving any claim, repair, replacement, refund, or store credit. APTERIX may also require the claimant to remove and ship the allegedly defective film to APTERIX for inspection at the claimant’s sole cost and expense.

Unauthorized removal, repair, replacement, alteration, or disposal of the Product before inspection by APTERIX may void the claim and this Limited Product Warranty.

7. Exclusions

This Limited Product Warranty does not cover, and APTERIX shall have no responsibility for, any defect, damage, failure, or performance issue caused in whole or in part by:

  • Improper storage, handling, preparation, installation, reinstallation, or removal

  • Installation by any person or entity other than an Authorized APTERIX Installation Center or facility

  • Use of non-recommended cleaning products, chemicals, compounds, solvents, or treatments

  • Environmental exposure, including acid rain, salt, industrial fallout, pollution, hard water, mineral deposits, oxidation, staining, or contamination

  • Abuse, misuse, neglect, improper maintenance, or failure to follow APTERIX care instructions

  • Physical damage, including rock chips, scratches, scuffs, scrapes, abrasions, punctures, tears, or impact damage

  • Automatic car washes, improper wash techniques, pressure washing near film edges, or abrasive towels, pads, or brushes

  • Accidents, collisions, vandalism, theft, fire, flood, hail, storms, acts of nature, or other external causes

  • Pre-existing substrate or glass damage, poor paint condition, repainted surfaces, failing clear coat, body repair, refinishing, corrosion, contamination beneath the film, glass defects, defroster lines, antenna elements, sealants, coatings, or other pre-existing conditions

  • Non-automotive, non-marine, or other non-approved applications

  • Unauthorized modifications or use outside approved applications

  • Use of non-APTERIX branded ceramic coatings, topcoats, additives, sealants, or third-party surface treatments not approved in writing by APTERIX

  • Commercial, fleet, rental, rideshare, racing, off-road, or unusually high-wear use, unless expressly approved in writing by APTERIX

  • Normal wear and tear

Without limiting the foregoing, this Limited Product Warranty does not cover:

  • Workmanship or installation-related issues

  • Labor, diagnostics, shipping, travel, downtime, loss of use, or similar expenses

  • Damage to paint, substrate, trim, glass, electronics, defrosters, antennas, sensors, or surrounding property

  • Any claim that installed tint is too dark, too reflective, non-compliant, or unlawful

  • Any variation between nominal film VLT and final installed VLT caused by factory glass, laminated glass, aftermarket glass, coated glass, or glass shading

  • Any claim based on customer expectations regarding heat rejection, cabin temperature, signal interference, glare reduction, UV protection, IR rejection, or TSER performance beyond the published specification for the applicable Product and test condition

  • Any fading, discoloration, distortion, haze, or optical effect caused by glass defects or pre-existing glass conditions

  • Any damage arising from removal, reinstallation, or breakage of glass or surrounding components

  • Any violation citation, failed inspection, or required removal due to law or regulation

The Product is designed to help reduce certain types of damage or heat transfer, but it does not prevent damage, temperature rise, glare, fading, breakage, or legal issues in all circumstances, and no guarantee of protection or performance outcomes is expressed or implied except as expressly stated in this Limited Product Warranty.

8. Installer Disclaimer

Authorized APTERIX installers, dealers, distributors, and sales representatives are independent businesses and are not agents, employees, partners, joint venturers, or legal representatives of APTERIX solely by virtue of selling or installing the Product.

APTERIX is not responsible for installer workmanship, representations, promises, statements, omissions, service quality, legal advice, or other acts or failures of any installer, dealer, or distributor.

No installer, dealer, distributor, salesperson, or other third party is authorized to modify this Limited Product Warranty or make any warranty, representation, or promise on behalf of APTERIX unless expressly approved in writing by an authorized officer of APTERIX.

9. Non-Transferability

This Limited Product Warranty is non-transferable and applies only to the Original Owner of the Registered Product. It automatically terminates upon sale, lease transfer, repossession, assignment, or any change in ownership of the vehicle, vessel, glass, or approved application in which the Product was installed.

10. Limitation of Remedies and Liability

The remedies stated in this Limited Product Warranty are the sole and exclusive remedies available under this Limited Product Warranty.

To the fullest extent permitted by applicable law, APTERIX shall not be liable for:

  • Special, incidental, indirect, exemplary, punitive, or consequential damages

  • Loss of use, loss of time, loss of business, loss of revenue, loss of profits, loss of goodwill, loss of reputation, or diminution in value

  • Costs of substitute transportation, storage, lodging, towing, hauling, slip fees, rental vehicle expense, or similar charges

  • Any amount exceeding the original purchase price of the Registered Product

Any remedy is limited to the Registered Product only and does not include labor or any non-product costs unless APTERIX expressly agrees otherwise in writing.

11. Disclaimer of Other Warranties

THIS LIMITED PRODUCT WARRANTY IS THE ONLY EXPRESS WARRANTY PROVIDED BY APTERIX PERFORMANCE FILMS LLC FOR THE PRODUCT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APTERIX DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY AND ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

THIS LIMITED PRODUCT WARRANTY SUPERSEDES ALL PRIOR OR CONTEMPORANEOUS ORAL OR WRITTEN STATEMENTS, MARKETING MATERIALS, PRODUCT LITERATURE, INSTALLER REPRESENTATIONS, AND OTHER COMMUNICATIONS CONCERNING WARRANTY COVERAGE FOR THE PRODUCT.

SOME STATES, PROVINCES, OR COUNTRIES MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES OR CERTAIN DAMAGES, SO SOME LIMITATIONS IN THIS LIMITED PRODUCT WARRANTY MAY NOT APPLY.

12. Governing Law; Arbitration; Class Action Waiver

This Limited Product Warranty shall be governed by and construed under the laws of the state, province, or country in which the Product was originally purchased, without regard to conflict-of-law principles, except to the extent preempted by applicable federal law.

Any dispute, claim, or controversy arising out of or relating to the Product, its sale, registration, installation, condition, performance, alleged defect, warranty coverage, or this Limited Product Warranty shall be resolved exclusively by binding arbitration, except where applicable law requires otherwise.

The arbitration shall:

  • Be conducted in Collin County, Texas, unless prohibited by applicable law

  • Be administered by the American Arbitration Association under its applicable rules

  • Be conducted on an individual basis only

Each party waives any right to a jury trial to the fullest extent permitted by law.

No claim may be brought as a class action, collective action, consolidated action, representative action, or private attorney general action, and no arbitrator shall have authority to hear or arbitrate any such proceeding except to the extent such waiver is prohibited by applicable law.

Each party shall bear its own attorneys’ fees and costs unless the arbitrator or applicable law provides otherwise.

13. Maintenance Requirements

To maintain eligibility for warranty coverage, the Original Owner must follow APTERIX maintenance and care requirements, including the following:

  • Wait at least forty-eight (48) hours after installation before washing the vehicle

  • Clean only with a soft cloth or mitt and pH-balanced soap, then rinse thoroughly

  • For APTERIX:SLR, use only ammonia-free cleaning products and soft, non-abrasive materials on interior film surfaces

  • Remove bird droppings, sap, bug residue, fuel spills, and similar contaminants promptly

  • Use only products approved or recommended for the applicable APTERIX Product

  • Avoid harsh chemicals, abrasive compounds, rough towels, brushes, and pads

  • Avoid improper pressure washing, especially near film edges

  • Inspect the Product regularly for lifting edges, bubbles, or other visible issues

  • Do not disturb drying bubbles that may self-resolve during the normal curing period

  • Seek service promptly if the film shows lifting, unusual bubbling, or other visible damage

Failure to follow these maintenance requirements may void this Limited Product Warranty.

14. Force Majeure

APTERIX shall not be liable for any delay or failure in performance under this Limited Product Warranty caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disruptions, supply chain interruptions, governmental actions, transportation delays, or material shortages.

15. Entire Agreement

This Limited Product Warranty constitutes the entire agreement regarding warranty coverage for the Product and may not be modified except in a written document issued by APTERIX Performance Films LLC.

No dealer, installer, distributor, or other person may alter, expand, or waive any term of this Limited Product Warranty unless expressly authorized in writing by APTERIX Performance Films LLC.
